CR.NO.77 OF 2016 OF MAILAM POLICE STATION Petition praying that in the circumstances stated therein the High Court will be pleased to relax the condition imposed that the petitioner appear before the learned Special Judge (Principal Sessions Court), Sessions Division, Villupuram, once in a month i.e. on the first working day of the English Calendar Month at 11.00 a.m. until further orders in Crl.M.P.No.10500 of 2016 in Crl.A.No.394 of 2014 dated 06.10.2016 Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.V.S.GOPU, Advocate for the petitioner and of MR.R.RAVICHANDRAN Government Advocate on behalf of the Respondent the court made the following order:- This miscellaneous petition has been filed seeking to relax the condition imposed by this Court on 06.10.
2016, where the appellant was directed to appear before the Special Judge (Principal Sessions Judge), Sessions Division, Villupuram, once in a month. This Court by order dated 31.07.2014 granted bail to the appellant on condition that the petitioner should appear before the trial Court twice in a week i.e. on Monday and Wednesday at 10.30 a.m. until further orders. Thereafter, the appellant had filed a miscellaneous petition in Crl.M.P.No.10500 of 2016, seeking to relax the condition imposed on 31.07.2014. This Court after hearing both sides, by an order dated 06.10.
directing the appellant to appear before the Special Judge (Principal Sessions Judge), Sessions Division, Villupuram, once in a month. Now again the appellant filed this present miscellaneous petition, seeking to relax the condition imposed by this Cour ton 06.10.2016. The appeal is of the year 2014 and the appellant is on bail from 2014 onwards and the condition was also already relaxed and the appellant is appearing before the Court only once in a month. This Court considering the above facts, insisted the learned counsel for the appellant to argue the appeal on merits. But the learned counsel still not ready to argue the matter and he is requesting the Court only to relax the condition.
Hence this Court is not inclined to allow this miscellaneous petition and the same is dismissed for the foregoing reasons.
