(CR.NO.64/2017) Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to modify the condition No.7(a) the petitioner shall surrender his passport before the learned Judicial Magistrate-I, Poonamallee imposed in Crl.O.P.No.21078/2018 dated 04.09.2018. Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.A.M.VENKATAKRISHNAN, Advocate for the petitioner and of MR. C.IYYAPPARAJ, Additional Public Prosecutor, on behalf of the Respondents the court made the following order:- This petition has been filed to modify the condition imposed by this Court in Crl.O.P.No.21078 of 2018 dated 04.09.2018.
2. When the matter is taken up for hearing, the learned counsel for the petitioner draw the attention of this Court that on 04.09.2018, this court, while granting bail to the petitioner, had imposed a condition that the petitioner shall surrender his Passport before the learned Judicial Magistrate-I, Poonamallee. The learned counsel for the petitioner would submit that the petitioner does not possess the passport. Though this Court passed an order in his favour, yet, the petitioner is not able to enjoy the fruits of the order on account of the aforesaid onerous condition. Therefore, the petitioners seeks to modify the said condition.
3. The learned Additional Public Prosecutor would submit that on verification, the petitioner dispossessed the passport. https://hcservices.ecourts.gov.in/hcservices/
4.Considering the submissions made by the learned counsel for the petitioner as well as the learned Additional Public Prosecutor, the question of surrendering the passport of the petitioner before the learned Judicial Magistrate, does not arise and accordingly, the condition imposed in respect of No.7(a) in Crl.O.P.No.21078 of 2018 dated 04.09.2018, shall stand deleted.
