CR.NO.6/AC/1999 Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased To relax the condition imposed by this Hon'ourable Court by its order dated 23.03.2017 in Crl.M.P.No.4440 of 2017 in Crl.A.No.170 of 2017 that petitioner will appear before court on 1st work day of every month at 10.30 a.m.

Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.P.PALANINATHAN, Advocate for the petitioner and of MR. K.PRABAKAR, Additional Public Prosecutor V and AC, on behalf of the Respondents the court made the following order:- This petition has been filed to relax the condition imposed on the petitioner by this court in Crl.M.P.No.4440 of 2017 dated 23.07.2017.

2. The learned counsel for the petitioner would submit that he is a senior citizen and he has been regularly complying with the condition. He would further submit that due to his old age he has to be accompanied by someone and thereby he is facing difficulty appearing every month and seek for relaxation of condition.

3. The learned Additional Public Prosecutor has submitted that the petitioner are regularly complying with the condition imposed by this Court.

4. Taking into consideration that the petitioner is regularly complying with the condition imposed by this Court, the condition imposed on the petitioner in Crl.M.P.No.4440 of 2017 dated 23.07.2017 is modified to the effect that the petitioner shall report before the learned Special Judge, [Chief Judicial Magistrate], Namakkal, at 10.30 a.m. on the first working day of the alternate months commencing from the month of December, 2018 until further orders. -sd/- 05/10/2018 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
