O R D E R

(Order of the Court made by M.DURAISWAMY,J.) The petitioner has filed the above Writ Petition to issue a Writ of Certiorarified Mandamus to call for the records relating to the order dated 13.08.2018 passed by the 1st respondent in respect of the alleged encroachment in S.No.390/1, to quash the same and consequently direct the respondents to restore the property of the petitioner's possession.

When the matter is taken up for hearing, Mr.V.Jayaprakash Narayanan, learned Government Pleader (i/c) appearing for the respondents 1 and 2 submitted that the 2nd respondent has already issued a notice under section 7 of the Tamil Nadu Land Encroachment Act, dated 29.08.2018 to the petitioner and the petitioner has already given a reply to the said notice, which is under consideration.

3. Since the petitioner has already given his explanation to section 7 notice, we are of the unconsidered view that the 2nd respondent may be directed to pass orders under section 6 of the Tamil Nadu Land Encroachment Act, taking into consideration the reply submitted by the petitioner.

In such view of the matter, the Writ Petition is disposed of by directing the 2nd respondent to consider the petitioner's reply dated 05.09.2018 and pass orders, under section 6 of the Tamil Nadu Land Encroachment Act. No costs.
