O R D E R

On the complaint lodged by one Guna, the respondent police have registered a case in Crime No.416/2018 on 28.04.2018 under Sections 420, 506 (1) of I.P.C against the petitioner and the petitioner was arrested on 16.07.2018 and remanded to custody. The petitioner filed Crl.M.P.No.14354 of 2018 before the Sessions Court, Chennai for bail and the learned Sessions Judge by order dated 03.09.2018, has granted bail to the petitioner on certain conditions, one of which is that:

"6(iii) The petitioner shall deposit title deeds worth Rs.5 lakhs before the said Magistrate."

2.This petition has been filed for modifying the said condition on the ground that the petitioner does not have any title deeds worth Rs.5 lakhs in his name.

3.Taking into consideration the fact that the petitioner was arrested as early as on 16.07.2018 and despite the order dated 03.09.2018, he has not been able to secure his release from custody, this Court modifies the said condition. 4.Accordingly, the condition No. 6 (iii) imposed by the Sessions Court in Crl.M.P.No.14354 of 2018 dated 03.09.2018 https://hcservices.ecourts.gov.in/hcservices/

stands deleted and in lieu of that, the petitioner shall deposit Rs.50,000/- to the credit of Crime No.416 of 2018 before the XV Metropolitan Magistrate, Chennai where the FIR is said to be pending. The learned XV Metropolitan Magistrate shall re-deposit the amount in any one of the Nationalised bank and the amount can be disbursed either to the accused or to the de facto complainant depending upon the outcome of the case in Crime No.416 of 2018. Rest of the conditions imposed by the Sessions Court shall remain the same.
