Petition praying that in the circumstances stated therein the High Court will be pleased to modify the order passed in Crl.M.P.4775 of 2017 in Crl.A.195 of 2017 dated 10.05.2017 by appearing before the Honble XI Addl.Special Judge for CBI Cases, Chennai on every Monday and pass such and other orders.[CRL.MP.NO.13779/2018]. Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.SUDHIR KUMAR B., Advocate for the petitioner and of MR.K.SRINIVASAN SPECIAL PUBLIC PROSECUTOR FOR CBI CASES, on behalf of the Respondent the court made the following order:- This petition has been filed to modify the condition imposed on the petitioner in Crl.M.P.No.4775 of 2017 in Crl.A.No.195 of 2017 dated 10.05.2017 against the C.C.No.62 of 2003 directing the petitioner to appear before the trial Court once in a week i.e., on every Monday at 10.30 a.m until further orders.

2. The learned counsel for the petitioner would submit that the petitioner has been regularly appearing before the trial Court.

3. The learned Special Public Prosecutor would submit that he has not received any instructions from the respondent. However, he would submit that the statement of petitioner with regard to their appearance before the trial Court, on due compliance of the order of this Court, is subject to verification.

4. Taking into consideration the submissions made by the counsels on either side, the condition imposed on the petitioner in Crl.M.P.No.4775 of 2017 in Crl.A.No.195 of 2017 dated 10.05.2017 against the C.C.No.62 of 2003 is modified. However, the petitioner shall appear before the trial Court once in a month, on the first working day of every English Calender month at 10.30 am, commencing from December 2018, until further orders.

5. Further, if it is found that the petitioner has not complied with the condition, on any occasion, the learned counsel for the respondent is at liberty to move appropriate petition. -sd/- 12/10/2018 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
