These three applications have been filed consequent to the death of the second appellant pending the second appeal. Applications have been filed seeking to bring on record as her legal representative the proposed third appellant, after condoning the delay in filing that application to set aside the abatement and to set aside the abatement. 2.Heard the learned counsel for the appellants and also the learned counsel for the respondents.
3.In view of the fact that the second appeal has been admitted and substantial questions of law have been framed at the time of admission, it would only be appropriate that the Court answers the substantial questions of law on merits, these applications are allowed, the delay is condoned and abatement is set aside.
