: Respondent Original Petition praying that this Hon'ble Court be pleased to (a) appoint an Arbitrator in respect of the disputes between the Petitioner and the Respondent as set out in this petition.
(b) direct the Respondent to pay the costof this petition.
This Original Petition coming on this day before this court for hearing in the presence of Mr.T.M.Naveen, Advocate for the Petitioner herein, and Mr.K.R.Ramesh Kumar, Advocate for the respondent herein and upon reading the Petition, and the supporting affidavit of G.Devendiran filed herein, and the order herein dated 01.11.2018, It is ordered as follows:
That Mr.S.A.Sriramulu, District Judge (Retd.,), Coimbatore, residing at Old No.39-A, New No.70, Bharathi Colony 2nd Street, Peelamedu, Coimbatore 641 004, be and is hereby appointed as the Sole Arbitrator to enter upon the reference and adjudicate the disputes inter se the parties, and the venue of the arbitration shall be fixed at Erode or at Coimbatore at the option of the parties.
2. That the learned Arbitrator appointed herein, after issuing notice to the parties and upon hearing them, pass an award as expeditiously as possible, preferably within a period of six months from the date of receipt of copy of this order.
3. That the learned Arbitrator appointed herein shall be at liberty to fix his remuneration and other incidental expenses.
4. That the proceedings shall be conducted under in accordance with the Madras High Court Arbitration Rules.
5. That both parties hereto, shall bear their own costs.
