B.Rajkumar v. The District Collector

W.P.No.26205 of 2018 THE HONOURABLE CHIEF JUSTICE and N.MALA, J (The Order of the Court was made by The Honourable Chief Justice) Status report has been submitted to show the action taken to remove the encroachment. However, the learned counsel for the petitioner submitted that other than the commercial building, no steps have been taken to remove the residential buildings pursuant to the direction of this Court. The learned Additional Advocate General prays and granted time to submit compliance report showing removal of all the encroachment. However, it is made clear that if action is not taken, and the order of this Court is not fully complied with, the District Collector shall remain present in the Court. It is made clear that his presence will not be excused on the next date of hearing on any ground whatsoever if compliance of the order is not made. Taking a liberal view at this stage, we dispense with his presence, but would not be on the next date of hearing if compliance is not made.
