PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Certiorarified Mandamus calling the files relating to the order dated 04.07.2017 made in No.13627/DRDM/C2/LGR-A/2016 and quash the same and consequently direct the 2nd respondent to grant house site patta to the petitioner in respect of her house in Survey No.1/1 Ayyankutipalayam, Oulgaret, Revenue Village, Puducherry. ORDER

The learned counsel for the petitioner submitted that during the pendency of this petition, the petitioner had passed away, however, deceased petitioner had filed a writ petition for issuance of patta. Hence, he would request that the present petition may be dismissed as abated with liberty to the daughter of the deceased petitioner who is a widow, to file a fresh application for issuance of patta, if she is eligible.

2. Recording the submission made by the learned counsel for the petitioner, this Writ Petition is dismissed as abated, however, legal heirs of the deceased petitioner who are entitled for grant of patta are granted liberty to approach the Government for appropriate orders for grant of patta, if they are eligible, the same shall be considered by the concerned authority if they are satisfied with the eligibility criteria. No costs. Consequently, connected miscellaneous petitions are closed.
