PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the first respondent to dispose the statutory appeal filed by the petitioner under Section 80A and 79 of the Town and Country Planning Act, dated 28.08.2018 on the order passed by the 2nd respondent in his proceedings Na.Ka.No.801/2018/Ku.Pu.Na.V.Ku, dated 20.08.2018. [Order of the Court was delivered by K.K.SASIDHARAN,J.] The petitioner has come up with this writ petition to direct the first respondent to dispose of the statutory appeal filed under Sections 80-A and 79 of the Town and Country Planning Act, challenging the order dated 20 August 2018.
2. When this writ petition came up for admission, we directed the learned Additional Government Pleader to take instructions with regard to the time required for disposal of the appeal.
3. When the writ petition is taken up for consideration today, the learned Additional Government Pleader on instructions submitted that the first respondent would dispose of the appeal within a period of two months. The said submission is recorded.
4. We direct the first respondent to consider and dispose of the appeal filed by the petitioner on merits and as per law. Such exercise shall be completed within a period of two months from the date of receipt of a copy of this order.
5. The writ petition is disposed of with the above direction. No costs. Consequently, connected miscellaneous petition is closed.
