These petitions are filed to (i) to condone the delay of 3593 days in filing an application to set aside the abatement caused due to the death of the sole appellant, (ii) to set aside the abatement caused due to the death of the sole appellant and (iii) to bring on record the appellants 1 and 2 as the legal heirs of the deceased sole appellant in the above Civil Miscellaneous Appeal.

2. The learned counsel appearing for the respondents did not raise any serious objection is allowing these petitions.

3. This court is also satisfied with the reasons stated in paragraph nos.5 and 6 of the affidavit filed in support of these petitions and in the facts and circumstances, these petitions are allowed.

4. The Registry is directed to carryout necessary amendment in the C.M.A.No.1744 of 2008 and list the same for final hearing on 11.11.2019 16.10.2019 mtl 1/2 http://www.judis.nic.in
