(Order of the court was made by the Hon'ble Chief Justice) This is an application for condonation of delay of 159 days in filing the appeal.

2. Heard Mrs.Sudharsanasundar, learned counsel for the applicant, and Mr.P.Muthukumar, learned State Government Pleader for respondents 2 to 4.

3. It is submitted that the first respondent is served.

4. Learned counsel for the applicant submits that the applicant was not made as party in the writ petition. From the date of knowledge, the same is within the limitation.

5. The grounds raised in the present application are not challenged by the respondents by filing any counter.

6. For the reasons stated in the accompanying affidavit, the delay of 159 days in filing the appeal is condoned. The application is allowed and disposed of.

7. The Registry is directed to number the appeal, if it is otherwise in order. After numbering, tag the appeal along with W.A.No.1690 of 2023 and list on 11.10.2023.
