ORDER
This contempt petition is filed to initiate appropriate action against the respondents for non-compliance of the order of this Court dated 12.01.2017 in W.P.No.1059 of 2017.
2. This Court, vide order dated 12.01.2017 in WP.No.1059 of 2017, which is the subject matter of contempt, has directed the concerned respondents to consider and dispose of the proposal of the petitioners, in the light of the orders and judgment of this Court passed in W.P.Nos.12007 and 12009 of 2008 and W.A.No.1363 of 2014.
3. When this contempt petition was taken up for hearing on 29.03.2019, the learned Government Advocate appearing for the State has produced the proceedings of the Director of Public Libraries dated 12.02.2018 in Na.Ka.No.462/A2/2017, rejecting the claim of the petitioners. However, this Court has directed the respondents to file a counter affidavit in support of the said proceedings.
4. Pursuant to the said direction, an affidavit of the Director of Public Libraries, Chennai - 600 002, dated 12.04.2019 was filed before the Court today.
5. Heard the submissions of Mr.P.Ganesan, learned counsel appearing for the petitioner and Mr.K.Karthikeyan,
learned Government Advocate for the respondents.
6. In the affidavit filed, a stand has been taken by the respondents that the petitioners having not been recruited through Employment Exchange and the second petitioner having not passed +2 Examination, they are not eligible for the post of Village Librarian in terms of G.O.(Ms)No.156 School Education Department, dated 10.09.1998; G.O.(Ms).No.422, School Education, dated 10.12.2012 and G.O.(Ms).No.144 P&AR Department,dated 20.11.2017.
7. In the light of the above, this Contempt Petition is closed. However, if the petitioners are so advised, they are at liberty to work out their remedy in the manner known to law, in the above cited proceeding, before the competent forum.
