Respondent PRAYER : Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the respondent herein to receive the application of the Petitioner, dated 19.09.2018, in Form CCPA and the prescribed fee for the grant of a Autorickshaw Permit to operate the vehicle within radius of 30 k.m. distance from Mecherry Bus Stand, Salem District.

O R D E R

This writ petition has been filed seeking a direction to the respondent to consider the petitioner's application for grant of Autorickshaw permit.

2.The grievance of the petitioner is that he has made an application to the respondent for seeking Autorickshaw permit on 19.09.2018. But the respondent refused to receive the said application on the ground that as per the existing Circular, Autorickshaw permit cannot be granted .

3.The learned counsel appearing for the petitioner submits that the is no statutory prohibition for granting Autorickshaw permit and the respondent is only relying upon the Circular, which is not applicable for grant of permit of Autorickshaw. He further submitted that the respondent may receive the petitioner's application and pass suitable orders. 4.Considering the limited prayer sought for, without going to the merits of the case, the respondent is directed to receive the petitioner's application and pass suitable orders on merits and in accordance with law within period of four weeks from the date of receipt of a copy of this order.

5. With the above directions, this writ petition is disposed of . No costs.
