JUDGMENT

[Delivered by P.N.PRAKASH, J.] Challenging his conviction and sentence in S.C.No.12 of 2014 dated 23.07.2018, imposed by the learned Additional District and Sessions Judge [FTC], Vellore, Vellore District, the appellant has filed the present appeal.

2. This Court, in Crl.M.P.No.3792 of 2019 in Crl.A.No.602 of 2018, granted suspension of sentence and bail on 15.03.2019.

3. Today, when the matter was taken up for final hearing, both sides submitted that the appellant died in a rail accident on 21.03.2020 in connection with which, a case is Katpadi P.S. Crime No.42 of 2020 was registered u/s.174 Cr.P.C.

4. Learned Additional Public Prosecutor submitted a copy of the First Information Report in Katpadi P.S. Crime No.42 of 2020. 2/4

5. Learned counsel for the appellant submitted that though the near relatives of the appellant are aware about the pendency of the present appeal, they are not willing to continue the appeal. In view of the above, this Criminal Appeal stands abates u/s.394(2) Cr.P.C.
