Prayer in Crl.O.P.No.23494/2018: Criminal Original Petition filed under Section 482 Cr.P.C., praying to modify the condition that the petitioner shall appear before the Judicial Magistrate at Thiruvottiyur daily at 10.30 a.m and 5.30 p.m for period of 30 days instead of the petitioner shall appear before the Judicial Magistrate No.II, Ponneri daily at 10.30 a.m. for period of two weeks order passed by the Judicial Magistrate at Thiruvottiyur in Crl.M.P.No. 4108 of 2018 in Crime No.237 of 2018 dated 05.07.2018.
For Petitioner : Mr.P.M.Vijay Praveen (in Crl.O.P.No.23467/2018) For Petitioner : Mr.T.Balachandran, (in Crl.O.P.Nos.23469 and 23494/2018) For Respondent : Mr.C.Raghavan, (in all the petition) Government Advocate C O M M O N O R D E R The petitioner is accused in Old Washermenpet Police Station in Crime No.339 of 2018; H-2, M.M Colony Police Station in Crime No.105 of 2018; M-3, Puzhal Police Station in Crime No.237 of 2018 and M-7 Manali New Town Police Station in Crime No.117 of 2018.
2.He was placed under arrest by all the aforesaid police and was remanded to judicial custody by the XV Metropolitan Magistrate, George Town at Chennai in Crime No.339 of 2018; by Judicial Magistrate, Thiruvottiyur for Crime Nos.105 and 237 of 2018; by Judicial Magistrate No.II, Ponneri in Crime No.117 of 2018. Since final reports were not filed in all the four cases, the petitioner has been released on bail by all the Magistrates under Section 167(2) Cr.P.C.
3.The learned XV Metropolitan Magistrate, George Town, while granting bail on 05.07.2018 in Crime No.339 of 2018 has directed that the petitioner should report before the Inspector of Police, H-1 Old Washermenpet Police Station at 10.30 a.m for a period of two 2 weeks; the learned Judicial Magistrate, Thiruvottiyur, while granting bail on 18.07.2018 in Crime No.105 of 2018 has directed that the petitioner should appear at 10.30 a.m and 5.30 p.m before that Court for 30 days; similarly, the Judicial Magistrate, Thiruvottiyur, while grating bail on 05.07.2018 in Crime No.237 of 2018 has directed that the petitioner should appear and sign daily at 10.30 a.m and 5.30 p.m before the said Court for 30 days and the learned Judicial Magistrate No.II, Ponneri, while granting statutory bail in Crime No.117 of 2018 has directed that the petitioner should report before that Court at 10 a.m everyday until further orders.
4.Since all these conditions are overlapping, the petitioner is now before this Court praying for modification of the aforesaid conditions, so that he can comply with the conditions without default.
5.The learned Government Advocate (Crl. Side) submitted that the petitioner is now reporting before the learned Judicial Magistrate No.II, Ponneri everyday at 10.00 a.m in Crime No.117 of 2018.
6.In view of the above, the condition imposed by the learned Judicial Magistrate No.II, Ponneri in Crl.M.P.No.1918 of 2018 in M-7 Manali New Town Police Station in Crime No.117 of 2018 stands relaxed. 7.The petitioner shall appear before the Inspector of Police, M-7 Manali New Town Police Station as and when required. The petitioner shall now report before the Judicial Magistrate, Thiruvottiyur at 10.30 a.m and 5.30 p.m for a period of 30 days in M.M Colony Police Station in Crime No.105 of 2018 and M-3, Puzhal Police Station in Crime No.237 of 2018.
8.After complying with the aforesaid conditions for 30 days, the petitioner shall report before the Inspector of Police, H1- Old Washermenpet Police Station in Crime No.339 of 2018 for a period of two weeks pursuant to the order dated 05.07.2018 in Crl.M.P.No.2212 of 2018 by the learned XV Metropolitan Magistrate, George Town. With the above direction, these petitions are modified.
