JUDGMENT

It is informed that the parties have settled the dispute amongst themselves and a settlement agreement dated 08.11.2023 has been entered into between the parties, a copy of which has been filed into this Court.

The learned counsel for the respondent would submit that in keeping with the settlement, as extracted in clause 3 of this agreement, 50% of the decree amount has been paid to them. The remaining 50% of the decree amount has to be paid. While granting stay by an order dated 28.02.2019, this Court had directed the appellant to deposit 50% of the decree amount which amount has also been paid. The appellant is therefore, permitted to withdraw the same.

In view of the submissions made by the learned counsel on either side, this appeal in A.S.No.100 of 2019 is dismissed as settled out of Court in terms of the settlement dated 08.11.2023. No costs.
