This petition is filed for effecting substituted service to the respondent No.2 by publication in any one of the Gujarathi & English daily, Gujarath edition.

2. The learned counsel for the petitioner submitted that the second respondent is evading service. He further submitted that the second respondent, who is the first defendant in the suit, remained ex-parte before the Trial Court.

3. Since the second respondent is evading service and it is not possible for the petitioner to serve in the ordinary course, this petition is ordered.

4. The notice by way of substituted service is ordered to the second respondent directing the learned counsel for the petitioner/appellant to publish about the appeal by effecting newspaper publication in any one of the Gujarathi and English leading newspaper circulated widely in the area concerned, indicating the date of hearing of the appeal as 26.10.2022. https://www.mhc.tn.gov.in/judis Page No.1/2
