This Civil Revision Petition has been filed challenging the Order of the trial Court dismissing the application filed to condone the delay of 1997 days in filing an application to set aside the exparte decree passed against the petitioners.

2. Though the revision has been filed challenging the Order of the trial Court dismissing the application filed under section 5 of the Limitation Act to condone the delay of 1997 days to set aside the exparte Order, the learned Special Government Pleader appearing for the petitioners would submit that the decree has been passed as early as on 23.08.2002 directing the petitioners to pay a sum of Rs.80,000/- along with interest at the rate of 9% per annum and also directing for the appointment wife of the plaintiff. Thereafter in pursuance to the decree, an Execution Petition has been filed in E.P.No.136 of 2005 and the same has been terminated on 16.06.2025. It is the contention of the learned Special Government Pleader that the amount has been settled as per the Lok Adalat Award dated 16.06.2025. In such view of the matter, as the Execution Petition itself has been terminated, nothing survives in this Civil Page 2 / 4

Revision Petition.

3. Recording the submissions of the learned Special Government Pleader, this Civil Revision Petition is dismissed. Consequently, connected miscellaneous petition is closed.
