Petition praying that in the circumstances stated therein the High Court will be pleased to relax the condition imposed by the Hon'ble Court that the petitioner shall appeal before the court once in a week on every Monday at 10.30 am by its order dated 10.05.2017 in Crl.M.P.No.4774/2017 in Crl.A.No.194/2017. Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.G.HARIHARAN, Advocate for the petitioner and of Mr.K.SRINIVASAN, SPECIAL PUBLIC PROSECUTOR, FOR CBI CASES, on behalf of the Respondent the court made the following order:- This petition has been filed to relax the condition imposed on the petitioner in Crl.M.P.No.4774 of 2017 in Crl.A.No.194 of 2017 dated 10.05.2017 against the C.C.No.62 of 2003 directing the petitioner to appear before the trial Court once in a week i.e., on every Monday at 10.30 a.m until further orders.
2. The learned counsel for the petitioner would submit that the petitioner has been regularly appearing before the trial Court.
3. The learned Special Public Prosecutor would submit that he has not received any instructions from the respondent. However, he would submit that the statement of the petitioner, with regard to their appearance before the trial Court, on due compliance of the order of this Court, is subject to verification.
4. Taking into consideration of the submissions made by the counsels on either side, the condition imposed on the petitioner in Crl.M.P.No.4774 of 2017 in Crl.A.No.194 of 2017 dated 10.05.2017 against the C.C.No.62 of 2003 is modified. However, the petitioner shall appear before the trial Court once in a month, on the first https://hcservices.ecourts.gov.in/hcservices/
working day of the every English Calender month at 10.30 am, commencing from December 2018, until further orders.
5.
