( Civil Appellate Jurisdiction ) Wednesday, the Ninth day of January Two Thousand Nineteen PRESENT THE HON`BLE MS.JUSTICE P.T.ASHA CMP No.23542 of 2018 and AS.No.920 of 2018 C.RAVICHANDRAN [ PETITIONER ] Vs SUBBULAKSHMI [ RESPONDENT ] Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to grant an order of interim injunction restraining the respondent her men and agents from in any way creating encumbrance or alienating the petition mentioned properties which is the subject matter in OSNo.160/2012 on the file of the learned first Additional District and Sessions Judge Tirupur (in CMP.No.23542/2018)pending disposal of the above AS.No.920/2018.

Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of N.MANOKARAN, Advocate for the petitioner the court made the following order:- This Civil Miscellaneous Petition is filed seeking an order of interim injunction restraining the respondent her men and agents from in any way creating encumbrance or alienating the petition mentioned properties which is the subject matter in O.S.No.160/2012 on the file of the learned I Additional District and Sessions Judge, Tirupur, pending disposal of this Appeal suit.

2. Considering the fact that any sale pending appeal would be hit by the principles of lis pendens and also the affidavit filed in support of the petition does not contain any sufficient reason, there is no necessity to grant any order of injunction as prayed for. Hence, this Civil Miscellaneous Petition is dismissed.
