NIRMAL KUMAR CRIMINAL MISCELLANEOUS PETITION No.13422 of 2018 IN CRL.A.No.152 of 2018 NAGU @ NAGARAJ, [ PETITIONER ] Vs STATE REP BY [ RESPONDENT ] THE INSPECTOR OF POLICE, KATPADI POLICE STATION, KATPADI, VELLORE DISTRICT.

Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to relax the condition imposed that the petitioner shall stay at Gudiyatham and appear before the concerned Judicial Magistrate on every Monday at 10.00 a.m. until further orders in Crl.M.P.No.3754 of 2018 in Crl.A.No.152 of 2018 dated 11.07.2018.

Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.VINODHKUMAR G. Advocate for the petitioner and of MR.R.PRATHAP KUMAR (ADDITIONAL PUBLIC PROSECUTOR) on behalf of the Respondent the court made the following order:- [Order of the Court was made by C.T.SELVAM, J] This petition has been filed to relax the condition imposed on the petitioner in Crl.M.P.No.3754 of 2018 in Crl.A.No.152 of 2018 on 11.07.2018.

2. This Court, by an order dated 11.07.2018, has suspended the sentence imposed on the petitioner and directed him to stay at Gudiyatham and appear before the concerned Judicial Magistrate on every Monday at 10.00.a.m until further orders.

3. We have heard learned counsel for petitioner as also learned Additional Public Prosecutor for respondent.

4. Learned counsel for petitioner submits that the petitioner has been complying with the condition imposed by this Court under order dated 11.07.2018.

5. This Court is of the view that the condition imposed on the petitioner may be relaxed. Hence, the condition imposed on the petitioner in Crl.M.P.No.3754 of 2018 in Crl.A.No.152 of 2018 shall stand relaxed to the effect that the petitioner shall now be required to appear before the concerned Magistrate at 10.30.a.m on the first working day of every month.

Accordingly, this Miscellaneous Petition shall stand allowed. -sd/- 10/10/2018 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.) High Court, Madras - 600 104.
