Prayer: Petition filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Mandamus directing the respondents R4 to R6 to appoint the petitioner to the post of PG Asst. Political Science vacancy arised on 05.10.2012 after cancel the 7th respondents invalid appointment and consequently direct the respondents R1 to R3 to approve the petitioner to the said PG post based on the petitioner's representation dated 28.04.2018. ORDER
The petitioner has filed this writ petition seeking a writ of mandamus to direct the respondents R4 to R6 to appoint the petitioner to the post of PG Asst. Political Science vacancy arose on 05.10.2012 after cancelling the 7th respondent's invalid appointment and to consequently direct the respondents R1 to R3 to approve the petitioner's appointment to the said post based on the petitioner's representation dated 28.04.2018. 2/4

The 7th respondent, whose appointment had not been approved in view of the representation given by the petitioner, had already filed a writ petition in WP.No.495/2021 by impleading the government respondents as well as the petitioner as respondents therein. The said writ petition was disposed of by setting aside the order of rejection and giving liberty to the petitioner in the said writ petition to make a representation to the 1st respondent authority in order to give fresh consideration for the matter. In pursuant to that, an order has been passed approving the appointment of the 7th respondent. In the meantime, this writ petition filed by the petitioner was dismissed for default, and later on, the petition filed by the petitioner was restored.
3. In fact, in this writ petition, the petitioner has also challenged the appointment of the 7th respondent. Whatever contention made by the petitioner in this writ petition could have been raised by the petitioner in the earlier writ petition disposed of in WP.No.495/2021. For reasons best known, the petitioner who has been impleaded as the 5th respondent in the above writ petition did not make his appearance. On the date when the order was passed in WP.No.494/2021, i.e., on 03.11.2021, the present writ petition was not pending. Hence, the writ petition stands dismissed. No costs. Consequently, connected miscellaneous petitons are closed.
