Vs SARAVANAN [ RESPONDENT ] S/O LATE RAMACHANDRAN, PLOT NO.10, NO.5, SHENBAGA STREET, MARUTHAM NAGAR, KAVUNDAPALAYAM, PONDICHERRY-605009 Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to withdraw HMOP.No.552/2017 on the file of the Family Court Judge, Pudhucherry and transfer the same to the file of Family Court Judge, Chengalpattu in Tr.CMP.No.747/2018.

Order :This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S B.

KUMARAVEL, ADVOCATE for Sole Respondent the court made the following order:- The transfer Civil Miscellaneous Petitions are posted today based on the letter written by the learned Judge, Family Court, Chengalpet for extension of time for disposal of the case in HMOP. No.552 of 2017.

2. The transfer Civil Miscellaneous petition has been filed by the petitioner to withdraw HMOP. No.552 of 2017 pending on the file of the Family Court, Puducherry and transfer the same to the file of the Family Court, Chengalpet.

3. The present Transfer Civil Miscellaneous Petition has disposed of by this Court vide order dated 17.12.2018 in Tr.C.M.P.No.747 of 2018 and C.M.P.No.18390 of 2018 with a direction to the learned Judge, Family Court, Chengalpet to dispose of the cases in HMOP. No.552 of 2017 and MC.No.19 of 2015 within a period of six months from the date of receipt of a copy of the order.

4. The learned Judge, Family Court, Chengalpet has sent a request vide letter dated 21.10.2019, to the Registry seeking permission to extend the time for disposal of the above said cases.

5. The learned Judge, Family Court, Chengalpattu has submitted that the case records have been received on 01.04.2019 from the Family Court, Puducherry and the same was re-numbered as FCOP. No.103 of 2019. After the legal formalities, the case is now posted for enquiry. Hence, the Court could not dispose of the cases within the stipulated time.

6. Now the learned Judge, Family Court, Chengalpet, seeking further extension of time to dispose of the cases.

7. In view of the above letter, this Court is inclined to extend the time to dispose of the above said cases within a period of three months from the date of receipt of a copy of this order. The parties are directed to cooperate with the said proceedings.
