( Civil Appellate Jurisdiction ) Wednesday, the Fourteenth day of July Two Thousand Twenty One PRESENT THE HON`BLE MR JUSTICE G.K.ILANTHIRAIYAN CRP No.3186 of 2018 AND CMP.NO.18199 OF 2018 PERIYASAMMY [ PETITIONER IN BOTH THE PETITIONS] Vs SANTHOSH [ RESPONDENT IN BOTH THE PETITIONS ] Under section 115 code of CPC filed against the fair and final order dt.11.07.2018 made in IA.No.118/2018 in OS.No.88/2013 on the file of Learned Subordinate Judge, Attur, Salem District IN CRP No.3186 of 2018 AND;

(II)to stay all further proceedings in EP.No.16/2016 in OS No.88/2013 on the file of the Learned Subordinate Judge, Attur, Salem district (IN CMP.NO.18199 OF 2018) pending disposal of the above CRP.No.3186 of 2018 Respectively.

Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.R.VASUDEVAN, Advocate for the petitioner the court made the following order:- This Petition has been filed before this Court under the caption "For extension of time" along with the report sent by the learned Subordinate Judge, Attur, in D.No.416 of 2021 dated 23.06.2021.

It is seen from the records, while disposing the petition in C.R.P.No.3186 of 2018, this Court by an order dated 17.08.2020, directed the trial Court to complete the trial proceedings in O.S.No.88 of 2013, within a period of four months. However, the learned Subordinate Judge, Attur has sent communication dated 23.06.2021 in D.No.416 of 2021, narrating the sequence of proceedings in O.S.No.88 of 2013 and sought further time of three months to complete the trial in the said case. https://hcservices.ecourts.gov.in/hcservices/

Considering the above facts and circumstances of this case, this Court is inclined to grant three months time to complete the trial in O.S.No.88 of 2013 from the date of receipt of copy of this order.
