PRAYER: Writ petition is filed under Section 226 of the Constitution of India for issuance of a Writ of mandamus to direct the 1st respondent to consider the petitioners representation dated 08.09.2018 by directing the 1st respondent to initiate the departmental action against the 2nd respondent for his negligence and abetment by invoking provision under Registration Act. ORDER

This Writ Petition has been filed to direct the 1st respondent to consider the petitioners representation dated 08.09.2018 by directing the 1st respondent to initiate the departmental action against the 2nd respondent for his negligence and abetment.

2. Despite the petitioner has sent a representation stating that criminal proceedings has to be initiated against the second respondent along with disciplinary action, no action has been initiated by the first respondent so far. The first respondent can consider the representation of the petitioner by passing orders but so far as the recording of the criminal case is concerned, even the petitioner can set the law in motion if he feels that the third respondent has committed some criminal offence during his course of employement.

3. In view of the same, the writ petition is disposed and the first respondent is directed to consider the representation of the petitioner and take an action and communicate to the petitioner as to the outcome of the action initiated by him, at the earliest. No costs.
