Crl.M.P.No.14697 of 2018 in Crl.RC.SR.No.48920 of 2018 V.PARTHIBAN,J., The present criminal revision case has been filed with condone delay application to condone the delay of 362 days in filing the criminal revision case against the order passed by the Principal Family Court, Coimbatore in M.C.No.12 of 2014 dated 28.06.2017.

2. The reasons as assigned in paragraph No.4 of the affidavit filed in support of this petition, are hardly convincing to this Court and does not carry much conviction and there is no proper explanation for condonation of delay of 362 days. This Court cannot accept such flimsy reasons as found in the affidavit filed in support of this petition. Moreover, it appears that the petitioner herein has not paid any amount as ordered by the above said Court, despite his employment as top executive in the private firm.

3. According to the respondent wife, there is an arrear of Rs.7,00,000/- to be paid as on date.

4. When the learned counsel for the petitioner was confronted by this Court whether the petitioner is willing to make any sizable amount, he would submit that the petitioner is unable to make any considerable amount. http://www.judis.nic.in

This Court however finds that the condone delay petition is not supported by proper reasons and no material has been produced in order to support the reason that the petitioner's health condition is not well and his condition of employment is also prevented him from filing the revision petition. In view of the same, the condone delay petition is without any merits and the same is dismissed.
