Respondents PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus to direct the respondents 1 and 2 to revive the suspension of the petitioner dated 30.10.2017 made in No.A4/11265/2017 passed by the second respondent based on the representation of the petitioner dated 16.02.2018 by reinstating him in service as Agriculture Officer forthwith.

Mr.Suriyanarayanan, learned Additional Government Pleader takes notice on behalf of the respondents.

2. By consent, this Writ Petition is taken up and disposed of at the stage of admission itself.

3. This Writ Petition has been filed seeking for a direction to the respondents 1 and 2 to revive the suspension of the petitioner dated 30.10.2017, made in No.A4/11265/2017 passed by the second respondent, based on the representation of the petitioner dated 16.02.2018, by reinstating him in service as Agriculture Officer forthwith.

4. The grievance of the petitioner is that he was put under suspension on 30.10.2017, by the second respondent, for being involved in a criminal case. Thereafter, he made a representation to the first respondent for revocation of suspension on 16.02.2018. Since, the same evoked no response, he has come before this Court seeking for the aforesaid relief.

5. Heard the learned counsel for the parties and perused the materials on record.

6. After hearing the learned counsel for the parties, and on going through the materials on record, especially the nature of relief sought for, this Court, without seeking reply affidavit, disposes of the Writ Petition at the stage of admission with a direction to the first respondent to take an informed and considered decision on the representation of the petitioner dated 16.02.2018, on merits and in accordance with law, if there is no other legal impediment, within a period of four weeks from the date of receipt of a copy of this order and intimate the decision taken thereof to the petitioner. However, it is made clear that this Court has expressed no opinion on the merits of the representation and as such this order should not be construed as mandate to consider the representation, in any particular manner. No costs.
