..Respondents PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the 3rd respondent to complete the investigation and submit the final report in Crime No.256 of 2016 dated 18.05.2016 in accordance with law, as expeditiously possible.

ORDER

This petition has been filed to direct the respondent Police to file a Final Report in Crime No.256 of 2016. 2.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor.

3.The learned Additional Public Prosecutor brought to the notice of this Court, the Status Report filed by the 3rd respondent Police. The relevant portion of the Status Report is extracted hereunder:

"3. I submit that during the course of investigation, the then Inspector of Police went to the scene of occurrence, prepared observation mahazar, drawn rough sketch in the presence of witnesses and also examined the witnesses and recorded their statements.

1) Tmt.Kamalapriya -defacto complainant/ petitioner/daughter of the deceased.

2) Tr.Paulraj - who friend of the defacto complainant's son friend.

3) Tmt.Latha-daughter of the deceased.

4)Tr.Vijyakanth - son of the defacto complainant.

5)Tr.Appandai Raj-husband of the defacto complainant.

6)Tr.Ramesh Arvind-son of the defacto complainant.

All of them corroborated the same version of the complaint.

4. I submit that later, then Inspector of Police conducted inquest over the dead body of the deceased/Ayyanna doss in the presence of Panchayatars by namely, 1) Tr.Veerakumar, 2) Tr.Ashok, 3) Tr.Sivaguru, 4)Tr.Iyyappan and 5) Tr.Sownther. Then, sent the dead body of the deceased through Post Mortem Constable Tr.Tirunavukarasu, PC2599 to the Government Hospital, Gingee for Post Mortem. After completion of Post Mortem, the deceased body was handed to the defacto complainant/ petitioner.

5.I submit that, the then Inspector of Police sent the collected samples of content of stomach, intestine and contents, liver and kidney and blood for Viscera to the Forensic Science Laboratory, Villupuram for Chemical Analysis and the same was yet to the obtained.

6.I submit that this case is under investigation and I have yet to collect the Viscera Report for final opinion from the concern authorities. Hence, for the above said reasons the case is till under investigation. Once the investigation is completed, I will lay a final report against the accused persons before the Court."

4. Recording the submissions made by the learned Additional Public Prosecutor and also the Status Report filed by the 3rd

respondent, this Criminal Original Petition is disposed of with the following direction:

"The respondent Police is directed to complete the investigation effectively and file a final report as expeditiously as possible."
