O R D E R

This petition has been filed to direct the learned Judicial Magistrate, Ootacamund, The Nilgiris to complete the trial in STC.No.2021 of 2017 expeditiously.

2.Heard the learned counsel for the petitioner and perused the materials placed on record.

3.The petitioner is the complainant in STC.No.2021 of 2017 pending on the file of the Judicial Magistrate Court, The Nilgiris under Section 138 of the Negotiable Instruments Act, 1881. On a reading of the A-Diary extract, it is seen that the accused was examined under Section 313 Cr.P.C. on 30.07.2018 and thereafter, the accused has been taking time for producing defence witnesses. Ultimately, on 05.09.2018, the defence side has been closed by the Magistrate and the matter was posted for arguments on 17.09.2018.

4.In view of the above, this Court directs the learned Judicial Magistrate, The Nilgiris to complete the trial in STC.No.2021 of 2017 within three months from the date of receipt of a copy of this order, provided there is no any other legal impediment.
