Respondents Prayer : Petition filed under Article 226 of the Constitution of India praying for issuance of a writ of habeas corpus calling for the entire records of the impugned detention order in DO.No.31/2018 C2 dated 25.07.2018 passed by the 2nd respondent and quash the same and directing the 2nd respondent herein to produce the body of the detenu R.Palani, Son of Ranganathan, aged about 46 years residing at Pillaiyar Koil Street, Mamandur Village, Arani Taluk, Tiruvannamalai District before this Court and set him at liberty forthwith.

ORDER

(Order of the Court was made by M.SATHYANARAYANAN, J) It is represented that very same detenu, challenging the Preventive Detention Order, passed under the provisions of the Tamil Nadu Act 14/1982, HCP.No.1642/2018 has been filed and the impugned order of detention has also been quashed and it appears https://hcservices.ecourts.gov.in/hcservices/

that for the very same detenu, to quash the order of detention, filed the present petition.

The learned counsel for the petitioner, on instructions, seeks permission of this Court to withdraw this petition and has also made an endorsement in the petition to that effect.

The Court heard the submissions of the learned Additional Public Prosecutor appearing for the respondents. In view of the submission and endorsement made by the learned counsel for the petitioner, this petition is dismissed as withdrawn.
