(CR.NO.RC.8/E/CBI/EOW) Petition praying that in the circumstances stated therein the High Court will be pleased to modify the condition No.(iii) imposed by this Honble Court in Crl.M.P.No.7937 of 2016 in C.A.No.580 of 2016 dt 23.8.2016 to allwo the petitioner to comply the condition any specific day as this Honble Court.
Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.JERRY V.V.SUNDAR Advocate for the petitioner and of MR.K.SRINIVASAN Special Public Prosecutor For CBI Cases on behalf of the Respondent the court made the following order:- The petition has been filed, seeking modification of condition imposed by this court in Crl.M.P.No.7937 & 7938 of 2016 in Crl.A.No.580 of 2016 dated 23.08.2016, directing the petitioner to appear before the trial Court on the 1st working day of every English Calender Month at 10.30 a.m.
2. The learned counsel for the petitioner would submit that the petitioner had been regularly appearing before the trial Court on the 1st working day of every English Calender month, all along and that on 01.10.2018, due to his illness, the petitioner was unable to appear before the Court and would submit that though the prayer for modification had been sought for he would restrict his prayer to condone the absence of the petitioner before the trial Court on 01.10.2018 and would seek that the petitioner may be permitted to continue complying with the condition passed by this Court. https://hcservices.ecourts.gov.in/hcservices/
3. In view of the above submission, the non-compliance of the condition by the petitioner on 01.10.2018 is condoned. However the petitioner shall abide by the condition dated 23.08.2016, until further orders.
