Respondents PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus to direct the first respondent to consider and pass orders on the representation of the petitioner dated 25.09.2018 for awarding two stars to the petitioner for the rope climbing event in the physical efficiency test for recruitment to the post of Grade II Police Constable, Grade II Jail Warder and Fire man for the year 2017-2018. Mr.V.Kadhirvelu, learned Special Government Pleader accepts notice on behalf of the respondents.
2. This Writ Petition has been filed seeking for a direction to the first respondent to consider and pass orders on the representation of the petitioner dated 25.09.2018, for awarding two stars to the petitioner for https://hcservices.ecourts.gov.in/hcservices/
the rope climbing event in the physical efficiency test for recruitment to the post of Grade II Police Constable, Grade II Jail Warder and Fire man for the year 2017-2018. 3.When this matter is taken up for hearing, Mrs.Narmada Sampath, learned Additional Advocate General represented by Mr.V.Kadhirvelu, learned Special Government Pleader who accepts notice on behalf of the respondents would submit that the respondents have already ventilated the grievance of the petitioner, by awarding three marks to him for rope climbing in addition to two marks already awarded to him. A proceeding dated 10.10.2018, of the Tamil Nadu Uniformed Service Recruitment Board, signed by Inspector General of Police, to that effect has also been produced before this Court. Hence, he would submit that the relief sought in this Writ Petition has become infructuous.
4. In such premises, the learned counsel for the petitioner seeks permission of this Court to withdraw this Writ Petition, by keeping his rights reserved, to challenge the decision taken. He had also made an endorsement to that effect.
5. In view of the submission made by the learned counsel for the parties and also in view of the endorsement made, this Writ Petition is dismissed as withdrawn, with liberty to challenge the decision taken, if so advised. No costs.
