7 THE ZONAL OFFICER, CORPORATION OF CHENNAI, ZONE XV, WARD NO.197, SHOLINGANALLUR, CHENNAI Writ Petitions under Article 226 of the Constitution of India praying that in the circumstances stated therein and in the respective affidavits filed therewith the High Court will be pleased to issue a Writ of Mandamus forbearing the respondents, their men, servants, or agents or anyone claiming under them from in any manner demolishing the constructions put up by the petitioners herein in their respective patta lands in Survey No. 494/ 28A, 494/ 28B, 494/ 27A, 494/ 1A1A2 and 602/ 6 and the punjai tharisu lands in survey No. 476/ 22 and 602/ 3A1A1A1 in Sholinganallur Village (WP.27016/2018) Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of MR.AR.L.
SUNDARESAN, SENIOR COUNSEL FOR M/S.AL.GANTHIMATHI, Advocate for the petitioner and of MRS.THANGAVADHANA BALAKRISHNAN, Additional Government Pleader on behalf of the 1 to 5 Respondents and of MR.A.ARUNMOZHI, Advocate for the 6 & 7 Respondents the court made the following order:- Heard the learned Senior Counsel for the petitioner. Mrs.Thangavadhana Balakrishnan, learned Additional Government Pleader takes notice for the respondents 1 to 5 and Mr.A.Arunmozhi, learned counsel takes notice for Respondents 6 and 7.
2. The learned counsel for the respondents seek time to get instructions.
3. The petitioners have taken up a specific contention that the notice was not issued before taking enforcement action by the respondents. The learned Additional Government Pleader is not in a position to inform us whether any such notice was given before proceeding with the enforcement action.
4. We direct the respondents to maintain status-quo as on today till day after tomorrow i.e., 12.10.2018.
5. This order is passed in the presence of the learned Additional Government pleader and the learned counsel for the Chennai Corporation. The respective counsels are directed to intimate the text of this order to the concerned respondents. Post on 12.10.2018.
