Petition praying that in the circumstances stated therein the High Court will be pleased to modify the condition that executing a bond for Rs.50,000/- (Rupees Fifty Thousand only) with two sureties each for like sum to the satisfaction of the Learned Additional Chief Metropolitan Magistrate, E.O.II Egmore in Crl.M.P.No.11793 of 2018 IN CRL.RC.NO.1007/2018 DATED 19.09.2018.[crl.mp.no.14048/2018] Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.N.CHANDRASEKARAN Advocate for the petitioner and of MR.K.SRINIVASAN SPECIAL PUBLIC PROSECUTOR FOR CBI CASES on behalf of the Respondent the court made the following order:- This Petition has been filed to modify the condition directing the petitioner to execute bond for Rs.50,000/-(Rupees Fifty thousand only) with two sureties each for like sum to the satisfaction of the learned Additional Chief Metropolitan Magistrate, E.O.II, Egmore in Crl.M.P.No.11793 of 2018 in Crl.R.C.No. 1007 of 2018 dated 19.09.2018.

2. The learned counsel for the petitioner would submit that by order dated 19.09.2018, this Court exempted the petitioner from surrendering and also suspended the sentence of imprisonment imposed on the petitioner with the condition that the petitioner to execute a bond for Rs.50,000/- with two sureties each for like sum to the satisfaction of the learned Additional Chief Metropolitan Magistrate, E.O.II, Egmore. The learned counsel would submit that the petitioner had appeared before the trial Court and learned Judge is insisting that the petitioner shall produce original title deeds of documents worth about Rs.50,000/-. He would also submit that two persons are prepared to stand as sureties, but they do not posses any property whereas the trial Judge is insisting for production of original documents. He would submit that the sureties in the alternative are prepared to furnish F.D receipts worth Rs.50,000/- as security before https://hcservices.ecourts.gov.in/hcservices/

the trial Court.

3. The learned Special Public Prosecutor would submit that this Court has imposed the condition, that the petitioner should execute a bond for Rs.50,000/- with two sureties for a like sum and that the petitioner has to satisfy the learned Magistrate.

4. Taking into consideration, the above submissions, the condition is modified to the effect that each of the sureties shall furnish the original F.D. Receipts each for Rs.50,000/- before the trial Court. The learned Magistrate shall keep the F.D. Receipts in the custody of the Court till disposal of the revision. The other condition stands unaltered.
