O R D E R

The petitioner faced prosecution in Crime No.63 of 2002 for the offences under Section 324, 323 and 506(2) IPC r/w Section 3 (1)(x) of SC/ST (POA) Act, in which he was acquitted. After acquittal, he has sent a representation dated 09.04.2018 by post to the Director General of Police against the Investigating Officer and has filed the present petition with the above prayer.

2.Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.

3.In the opinion of this Court, just because, the petitioner was acquitted in Crime No.63 of 2002, it will not mean https://hcservices.ecourts.gov.in/hcservices/

that a false case has been foisted on him. It is common knowledge that there are several reasons for acquittal of an accused. In most cases, the witnesses turn hostile for various extraneous reasons. Therefore, action cannot be taken against the Investigating Officer, who had investigated the case in the year 2002 on the ground that the accused was acquitted.
