When the case was listed on 01.08.2022, this Court, upon considering the submissions made by the learned counsel for the petitioner as well as for the respondents, disposed of the present civil revision petition. Before signing the order, since certain doubts arose in the matter, the Registry was directed to list the case under the caption "for clarification" on 23.08.2022 .
2. Today (23.08.2022), the case is listed under the caption "for clarification". After hearing both sides, the following order is passed:- The learned counsel for the petitioners filed an affidavit dated 18.07.2022, wherein it is specifically stated that since the petitioners have leased out the premises to third party, they would request six months' time for demolition of the second floor and to put up slopped roof at the top floor. Further, the petitioners have also given an undertaking to submit necessary revised plan to that effect, before the Commissioner, Udhagamandalam, the Page No:2/4
Nilgiris within a period of six months thereafter. The undertaking filed by the petitioners, dated 18.07.2022 is taken on record and the same shall form part of the record.
3. This Civil Revision Petition stands disposed of in terms of the undertaking given by the petitioners. No costs. Consequently, connected miscellaneous is closed.
