ORDER

This petition has been filed to call for the records in C.C.No.97 of 2017 on the file of the learned Judicial Magistrate, Tambaram and quash the same.

2. On the complaint lodged by Ponnappan, the respondent police registered a case in Cr.No.1574 of 2016 and after completing the investigation, filed a charge sheet in C.C.No.97 of 2017 before the Judicial Magistrate, Tambaram under Sections 294(b), 323 and 506(i) IPC against Kutty @ Sagadevan, for quashing which, this application has been filed on the ground that the parties have arrived at a compromise.

3. Today, Ponnappan, the de facto complainant and Kutty @ Sagadevan are present and they are identified by Ms.J.Seela Jebamani, WHC 35681, S-14 Peerkankaranai Police Station and they https://hcservices.ecourts.gov.in/hcservices/

have filed a memo of compromise dated 10.10.2018 in Tamil.

In view of the above, this petition is allowed and the prosecution in C.C.No.97 of 2017 on the file of the Judicial Magistrate, Tambaram is hereby quashed on condition that the petitioner shall pay a sum of Rs.1,000/- (Rupees one thousand only) as costs to the credit of the Chief Justice Relief Fund (payable in Accounts Section of the High Court Registry), within a period of two weeks from the date of receipt of a copy of this order and file a photocopy of the receipt along with a memo reporting compliance in the Registry.
