This Writ Petition is filed under Article 226 of Constitution of India seeking Writ of Certiorarified Mandamus to call for the records relating to impugned order passed by the 2nd respondent in Na.Ka.No. 10656/ 2016/ Pa2 dated 21.05.2018 and quash the same and consequently direct the respondents to revoke the petitioners suspension dated 18.08.2016.

ORDER

The petitioner has filed this Writ Petition seeking to quash the impugned order passed by the 2nd respondent in Na.Ka.No. 10656/ 2016/ Pa2 dated 21.05.2018 and to direct the respondents to revoke the petitioner's suspension.

2. The brief facts of the case are that the petitioner was working as a Bill collector in the third respondent's office. He was arrested on 16.08.2016 by the Inspector of Vigilance and Anti-corruption, Salem, for demanding a bribe of Rs.1,000/- from N.Kanagaraj. A case was registered against him under the Prevention of Corruption Act, 1988. He was suspended from service on 18.08.2016 and despite the passage of time, the respondents have not filed a final report or paid the petitioner the increased subsistence allowances of 75%

of his last drawn salary, which is admissible after 6 months of suspension. The petitioner made a representation to revoke the suspension and the same was rejected by the second respondent on 21.05.2018, citing the pending criminal case. Aggrieved by the same the petitioner has filed this Writ Petition.

3. The learned counsel for the petitioner is present before this Court.

4. The learned Government Advocate, appearing for the respondents informs to this Court that a fresh appointment has already been given to the petitioner as a Bill Collector, and therefore, the cause in the present case does not survive.

5. Recording the submission made by the learned Government Advocate, this Writ Petition is dismissed. No costs.
