ORDER
This criminal original petition has been filed seeking direction to dispose of the case in C.C.No.41 of 2015 pending before the learned Judicial Magistrate, Tiruvottiyur.
2.The learned Additional Public Prosecutor would submit that the case in C.C.No.41 of 2015 is pending before the Court below for the offences under Sections 279, 337 of IPC and subsequently the Sections were altered into 279 and 304 (A) IPC. The learned Additional Public Prosecutor would further submit that there is no regular Assistant Public Prosecutor in the Judicial Magistrate Court No.II, Ponneri. Therefore, the Court below could not proceed further to examine witnesses in the above case and also the witnesses PW1 to PW3 were not cross examined by the defence side.
3.In view of the above, there shall be a direction to the learned Judicial Magistrate, Tiruvottiyur, to complete the entire proceedings within a period of three months from the date of receipt of a copy of this order. https://hcservices.ecourts.gov.in/hcservices/
