This petition has been filed to restore the above second appeal, which was dismissed for non prosecution on 20.09.2018.

2.The learned counsel for the respondents have no objection to allow the petition.

3. This Court is satisfied with the reasons stated in the affidavit filed along with the petition.

4.Accordingly, the civil miscellaneous petition is allowed. The Registry is directed to post the second appeal in SA.No.1688 of 1997 on 09.01.2020 "for final hearing".
