O R D E R

This petition has been filed seeking a writ of certiorarified mandamus calling for the entire records relating to the impugned order passed by the 2nd respondent in his proceedings No.Naka 07/Circle/Memorandum/18 dated 15.10.2018 and quash the same and consequently, direct the respondents to give necessary permission for conducting State Level Kabadi Tournament at Kandipalayam Village, Namakkal District on 27.10.2018 and 28.10.2018 (Saturday and Sunday) from 10.00 a.m. to 9.00 p.m.

2. Today, Mr.R.David Balu, Special Sub-Inspector of Police, Jedar Palayam, is present.

The petitioner gave a representation to the second respondent police seeking permission to conduct Kabadi Tournament on 27.10.2018 and 28.10.2018 at Kandipalayam Village, Namakkal District and the said representation has been rejected by the second respondent by order dated 15.10.2018, challenging which, the petitioner is before this Court.

4. Heard Mr.C.Prakasam, learned counsel for the petitioner and Mr.C.Raghavan, learned Government Advocate (Crl.Side) appearing for the respondents-State.

5. Mr.C.Prakasam, learned counsel contended that for the last several years, the petitioner has been conducting the Kabadi Tournament at Kandipalayam Village and there had not been any untoward incident so far, but, strangely, the second respondent has now denied permission.

6. On instructions, learned Government Advocate (Crl.Side) submitted that in June 2018, there was a clash between the members of the Vanniyar Community and the Vettuva Gounder Community in connection with the administration of a temple and the situation is not conducive for conducting Kabadi Tournament. However, learned Government Advocate (Crl.Side) submitted that the police are willing to grant permission to conduct the Kabadi Tournament at Vadakaraiathur, which is hardly 1 km. from Kandipalayam.

Recording the above submission, this Court directs the petitioner to give a fresh representation to the second respondent and on such representation being given, the second respondent shall grant permission to conduct the Kabadi Tournament at Vadakaraiathur and provide police protection to the organisers and players for conducting the Kabadi Tournament from 10.00 a.m. on 10.11.2018 to 10.00 p.m on 11.11.2018 (Saturday and Sunday) .

Accordingly, this petition is ordered.

No costs.
