Petition filed under Article 226 of the Constitution of India praying for issue of Writ of Mandamus directing the respondents 1 to 4 not to permit the 5th and 6th respondents to conduct illegal public auction scheduled to be conducted on 30.10.2018 published in notice dated 02.10.2018 which is published in "Dinamani News Paper"until pending disposal of O.S.No.328 of 2018 on the file of II Additional District Court, Salem, which was filed by the petitioner.

O R D E R

Learned counsel for the petitioner sought permission of this Court to withdraw the writ petition with liberty to approach the Debts Recovery Tribunal challenging the auction notice dated 02.10.2018. The learned counsel has also made an endorsement to that effect.

2. In view of the submission made by the learned counsel for the petitioner, the writ petition is dismissed as withdrawn. It is open to the petitioner to challenge the auction notice before Debts Recovery Tribunal in accordance with law. No costs.
