ORDER

This Criminal Original Petition is for a direction to the respondents 1 to 3 to consider the representation of the petitioner dated 20.09.2018 to extend the tenure of the one A.G.Ponn Manickavel, IPS, Inspector General of Police cum Head of the Special Team [deleted 4th respondent] and to direct him to conduct investigation in idol theft cases.

2. There is no representation for the petitioner.

The learned Government Advocate (Crl.Side) on instructions would submit that the prayer has become infructuous as the said person has retired from service in the year 2018 and his tenure was extended till 30.11.2019 and thereafter, it was not extended. He produced a copy of the order passed by the Hon'ble Supreme Court in MA No(s.).21572158/2019 in C.A.No(s).3918-3919 of 2019 dated 12.04.2019, which reads as follows:

"The tenure of the Special Officer was till 30.11.2019. The term is now over. Mr.Mukul Rohatgi, learned senior counsel submits that the record of the investigation and other records, which were with the Special Officer, are required to be handed over to the Head of the Department. Learned counsel for the Special Officer submits that he is ready to hand over the entire record to the High Court. We are of the view that entire record of the investigation and other records, which are in the possession of the Special Officer, has to be handed over to the Head of the Department (Idol Wing). We order accordingly.

4. In view of the submissions made by the learned Government Advocate (Crl.Side) and the order passed by the Hon'ble Supreme Court, nothing survives for adjudication in the Criminal Original Petition. Hence, the Criminal Original Petition stands dismissed. 24.02.2025 ars 3/4
