Respondents Writ Petition filed under Article 226 of the Constitution of India praying this Court to issue a Writ of Mandamus directing the respondents to sanction and disburse the Deathcum-Retirement-Gratuity amount and other retirement benefits inclding encashment of surrender of earned leave and unearned leave on private affairs and regular pension arrears along with the provisional pension arrears w.e.f.01.03.2017 with interest on the delayed payments with effect from the date on which it becomes due and payable to the petitioner till the date of actual disbursement to him.

ORDER

( Order of the Court was made by The Hon'ble Chief Justice) Heard learned counsel for the petitioner and learned

counsel for the respondents.

2. The petitioner has been permitted to superannuate at the age of 58 years after a Resolution passed by the High Court and a copy of the same has been produced before us.

3. Learned counsel for the petitioner, however, submits that the petitioner is entitled to all his emoluments which may be admissible as per Rules.

4. Having perused the Official Memorandum dated 13.02.2020, nothing survives to be adjudicated in this writ petition except directing the respondents to ensure all the payments that are admissible to the petitioner in accordance with law, preferably, within a period of two months from the date of receipt of a certified copy of this order.

5. The writ petition stands closed with the above said direction. No costs, Consequently, connected miscellaneous petition is closed.
