Respondents Prayer:- Writ petition filed under Article 226 of the Constitution of India, praying for a writ of mandamus forbearing the respondents herein from opening TASMAC Liquor shop at Survey No.2B/17Ao.16 situated in the Nallambakkam Village, Nallambakkam Panchayat, Kattankulathur Union, Chengalpattu Taluk, Kanchipuram District by considering the petitioner's representation dated 29.06.2018 within the time stipulated by this Court. ORDER
[Order of the Court was made by M.SATHYANARAYANAN, J.,] By consent, the writ petition is taken up for final disposal. Mr.E.Manoharan, learned Additional Government Pleader appears on behalf of the 1st respondent and Mr.P.Arumugarajan, learned Standing counsel appears on behalf of the respondents 2 and 3.
The writ petition is styled as a Public Interest Litigation and according to the petitioner, he is a resident of Kelambakkam Panchayat, Thiruporur Taluk, Kancheepuram District and there is a proposal to open a Liquor Shop by the Tamil Nadu State Marketing Corporation Limtied [TASMAC] in Survey No.2B/17Ao.16, admeasuring to an extent of 0.16 cents situate in the Nallambakkam Village, Nallambakkam Panchayat, Kattankulathur Union, Chengalpattu Taluk, Kanchipuram District. The matter was listed for hearing on 29.11.2018 and the learned Standing counsel appearing for TASMAC, accepted notice and sought time to get instructions.
When the matter is listed today, the learned Standing counsel appearing for TASMAC has produced a communication dated 13.12.2018 in RC.No.886/A6/2012 sent by the Deputy Collector/District Manager, TASMAC Limited, Kancheepuram [South], addressed to him and the contents of the same would disclose that no such proposal is proposed, to locate the TASMAC shop in the said survey number. The said communication is taken on file and record.
In the light of the subsequent development, nothing remains for further adjudication in this writ petition. Accordingly, the writ petition stands closed. No costs. Consequently, connected miscellaneous petition is also closed.
