PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Certiorarified Mandamus, calling for the records on the file of the 1st respondent herein in Government Letter No.60529/T&A-1/2016 dated 12.07.2017 and quash the same and to direct the respondents herein to promote the petitioner as Accounts Officer, pursuant to the inclusion of his name in the panel for the year 2015-2016, approved in G.O.Ms.No.56, Finance (T & A-1) Department dated 20.02.2016, with Page No.1 of 4

retrospective effect from 05.08.2016 and to grant him all consequential service and monetary benefits.

ORDER

The learned counsel appearing for the petitioner submitted that in view of the death of the petitioner, the disciplinary proceedings pending against him shall get abated in accordance with the orders issued in G.O.Ms.No.2299, Public (Ser.) Department dated 04.12.1969.

In view of the above, the Writ Petition stands dismissed as abated. Consequently, the connected Miscellaneous Petition is closed. There shall be no order as to costs. Since the charges against the petitioner get abated, it is appropriate for the respondents to pass suitable orders for the release of terminal benefits if any to the legal heirs of the deceased. 13.03.2025 rpl Index :
