2.In view of the submission made by the learned counsel for the appellant, the 2nd respondent is given up in the First Appeal.
3.There is a delay of 138 days in filing the First Appeal.
4.The learned counsel for the 1st respondent has no serious objection for condoning the delay.
5.Further, we are satisfied with the reasons stated in the affidavit filed in support of the petition.
6.In view of the same, the delay is condoned. The petition is ordered.
