BY THE INSPECTOR OF POLICE, CBI/EOW/CHENNAI.

Petition praying that in the circumstances stated therein the High Court will be pleased to relax the condition the petitioner/appellant shall report beofre the XI Additional Sessions Judge cum Special Court for CBI Cases, Chennai on the first working day of every month at 10.30 am imposed on the petitioner in Crl.M.P.No.13446 of 2016 in Crl.A.828/2016.

Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.K.P.ANANTHA KRISHNA, Advocate for the petitioner and of MR.K.SRINIVASAN SPECIAL PUBLIC PROSECUTOR FOR CBI CASES on behalf of the Respondent the court made the following order:- The learned counsel for the petitioner is absent.

2. This petition has been filed to relax the condition imposed on the petitioner in Crl.M.P.No.13446 of 2016 in Crl.A.No.828 of 2016 dated 02.01.2017 directing the petitioner to appear before the learned XI Additional Special Court (CBI Bank Fraud Cases), Chennai on the first working day of every English Calendar Month at 10.30 a.m, until further orders.

3. The learned counsel for the petitioner would submit that the petitioner has been regularly complying with the condition all along and would submit that the petitioner aged about 65 years and that due to his old age and ill health finds it difficult to appear every month and would seek for modification of condition.

4. The learned Special Public Prosecutor for CBI would submit that the petitioner has been regularly complying with the condition all along.

Taking into consideration of the submissions made by both the counsels, the condition is modified to the effect that the petitioner shall appear before the trial Court on alternative months on the first working day of concerned month at 10.30 a.m until further orders, starting from the month of December 2018. -sd/- 30/10/2018 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
